FINAL Promontory Overlay District (Hotel) proposal recommended to Council (updated)

The PC formally recommended a proposed amendment to create a (hotel) overlay and to amend the Zoning Map for the overlay boundaries and – following a Council public hearing on Saturday, 5 December – considered modifications proposed by Council during the Commission's regular meeting on 17 December 2015.  The PC made a few additional clarifications and adjustments which would allow the Council to proceed directly to enactment of the ordinance and adoption of the overlay boundaries.  In the unanimous view of the PC (with the Council representative abstaining to avoid voting twice on the matters), the recommendations "respond to all stakeholders’ expressed concerns in an equitable manner which is legally defensible by fully respecting current and future property owner rights and their equal protection".  This includes all three concerns expressed in the June 2014 petition.  A supplement to the PC Study & Findings has also been prepared.  All PC recommendations can be found at the above external site.  The September 2013 PC Study & Findings – upon which this concept has been based – can be found here.

PLANNING COMMISSION

The objectives of the Harpers Ferry Planning Commission, in its advisory capacity, are to promote the orderly development of the Town; preserve, protect, and foster the rehabilitation of its historic edifices; provide healthy surroundings for family life; to insure that growth of the community is commensurate with its historic significance; and such other objectives, as set forth in West Virginia Code.  The Commission consists of nine appointed members, one of whom must also be a member of the Town Council.  For complete information, refer to Article 133 of the Codified Ordinances of Harpers Ferry.

Regular monthly meetings of the Planning Commission are held at 7:00 p.m. on the Tuesday immediately following the third Monday of each month.  Additional meetings are occasionally required.  All meetings are open to the public and are held upstairs at Town Hall.
